NRST tax refund must answer questions

Friends who are applying for NRST refund now, each case must answer the following questions, are you ready?

The affidavit must also include the following statements:

I, (insert name), am requesting a refund of the NRST I paid when I purchased this property, located at (insert the exact address of the property you own).

I (set out name) am applying for a rebate of the NRST paid at the time I acquired my home, with the municipal address of (fill in the municipal address).

I have occupied this property as my primary residence since (year/month/day) and have lived there until (now or year/month/day). Please also attach proof of residence for each month since you moved in (such as monthly bank statements, internet bills, telephone bills, etc. Note: Home insurance, water, electricity, gas bills, and land tax bills are not recognized by the government) 

I started to occupy the home as my principal residence on (YYYY/MM/DD) and have continued to occupy it to (Present or YYYY/MM/DD). Attached hereto as an exhibit is evidence for each month of my occupation of the home as my principal residence.

I am the actual beneficiary of the land as of (date of property handover), which is the date on which the Registration of Instrument No. (AANNNNNN) and the Land Transfer Tax ($NNNNNN) and Foreign Buyer Tax ($NNNNNN) are paid.

I am the beneficial owner of the land and always have been since (set out date) when the beneficial ownership was acquired by the registration of Instrument No. (AANNNNNN) and the applicable land transfer tax ($NNNNNN) and NRST ($NNNNNN) was paid.

The other beneficial owners of the land are (list names) and their relationship to me at the time of my purchase of the house is (list relationship status). If none, ignore.

The other beneficial owners of the land are (set out names) and their relationship to me at the time I purchased the home is (set out relationship status).

The other transferees mentioned in the Transfer are (list names), and their relationship to me at the time of purchase is (list relationship status). If there are none, you can ignore it.

Other transferees named in the conveyance are (set out names) and their relationship to me at the time I purchased the home is (set out relationship status).

All funds used to purchase the land and the residence contained therein were used in favor of (property owner, name) and the source of funds was (specify name). (If any portion of the funds came from someone other than the beneficial owner, such as a gift from a parent, please fully explain the circumstances).

All monies and other considerations utilized in the acquisition of the land relating to the conveyance were beneficially owned by (set out the name) and the source of the funds was (set out the name). (If the origin of any part of the consideration was anyone or anything other than the beneficial owner (ie a gift), fully explain the circumstances).

My annual income is $nnnnn; attached is my income tax return and my notice of assessment or notice of reassessment from the year before the purchase of the land. Also attached is my bank account statement showing that I pay my mortgage, utility bills, property taxes, condo fees and insurance.

That my annual income is $NNNNNN; and attached hereto as an exhibit are my Income Tax Return(s) and accompanying Notice of Assessment or Notice of Reassessment(s) since the year before the purchase of the land. Attached hereto as an exhibit are my bank account statements evidencing payment of the mortgage, utilities, municipal taxes, condo fees, insurance.

My annual income is $nnnnn; attached is my income tax return and my notice of assessment or notice of reassessment from the year before the purchase of the land. Also attached is my bank account statement showing that I pay my mortgage, utility bills, property taxes, condo fees and insurance.

That my annual income is $NNNNNN; and attached hereto as an exhibit are my Income Tax Return(s) and accompanying Notice of Assessment or Notice of Reassessment(s) since the year before the purchase of the land. Attached hereto as an exhibit are my bank account statements evidencing payment of the mortgage, utilities, municipal taxes, condo fees, insurance.

If the applicant's income (and that of his or her spouse) is not enough to cover the costs of purchasing the property (such as mortgage, utility bills, property taxes, condo fees, insurance and repairs), explain where the funds to pay for the land will come from.

If the applicant's income (and his or her spouse's income) is not sufficient to cover expenses for the house (eg, mortgage, utilities, municipal taxes, condo fees, insurance, and upkeep) explain where the funds to pay for the land and its expenses came from.

All obligations, including any mortgage obligations, liabilities, acts or omissions, during my ownership of the property belong to me and will be fulfilled by me.

All obligations, including any mortgage obligations, responsibilities, acts or omissions pertaining to the land during the period of time it was and is vested in me has and will be performed by me.

I attach herewith as an attachment a copy of the Purchase and Sale Agreement pursuant to which I acquired beneficial title to the land and paid the NRST;

Attached hereto as an exhibit is a photocopy of the agreement of purchase and sale pursuant to which I obtained beneficial ownership of the land and paid the NRST;

If the land is to be sold, all proceeds from the sale will belong to (specify name, usually the property owner)

If the land were to be sold, all proceeds of the sale will belong to (set out name)

If I die, the land will pass through my estate and be dealt with according to applicable succession laws. Or, if not, explain how ownership of the land will change upon your death.

If I should die, the land would pass through my estate and be disposed of through the applicable inheritance laws. Or, if not, explain how ownership of the land would change upon your death.

I am entitled to all relevant interests and benefits of the property, or the interests and benefits of the property belong to (insert name).

I am entitled to all income from the property OR, the income from the property belongs to (set out name).

I do not hold land in trust for anyone, or, I hold land in trust for (fill in name and relationship).

I do not hold the land in trust for anyone OR, I hold the land in trust for (set out the name and relationship).

 

Note: The Compliance Branch of the Ministry of Finance may require further evidence of actual ownership and transfer of the land. If the source of funds for the purchase of the land is not the beneficial owner, an affidavit of the source of funds may be required.
